Legal Terms & Privacy Policy

Any reference to “we,” “us,” or “our” refers to the business entity, not an individual person.

Acceptance of Terms

By accessing this website, submitting a form, booking services, or making payment, you agree to these Legal Terms and all policies published at https://gabbyeato.com/legal .

No Refunds & Final Sale

Eleable® provides custom, time-based, strategic, and intellectual services that require advance preparation and reserved availability.

All services, audits, subscriptions, and digital products are final sale. Refunds, partial refunds, credits, or reversals are not offered.

We encourage questions before booking so expectations are aligned with clarity and care.

Payments, Late Fees & Offer Forfeiture

Payment is required before work begins unless otherwise agreed in writing.

Payments not made on time incur a $100 per day liquidated administrative fee , accruing daily until paid in full.

If an invoice is not paid within twenty-four (24) hours of issuance, the associated offer, scope, or reserved availability may be forfeited and may no longer be honored.

Forfeited availability or withdrawn scope does not cancel or void the agreement. The service agreement remains fully enforceable. The full outstanding balance remains legally due and payable. Forfeited availability or withdrawn scope does not cancel, void, terminate, or invalidate the signed agreement. Any executed contract remains fully binding and enforceable. The full outstanding balance remains legally due and payable. The total billed amount must be paid in full regardless of forfeiture, paused services, unused time, or discontinued communication.

Pricing, Annual Adjustments & Website Maintenance

Eleable® pricing may be reviewed and adjusted periodically, including on an annual basis. Pricing may change to reflect changes in operating costs, technology, third-party services, project requirements, accessibility standards, legal or regulatory developments, security needs, or the level of work required to support or maintain a website.

Any revised pricing will be communicated in writing and will apply according to the terms of the applicable proposal, invoice, renewal, maintenance plan, subscription, or service agreement. Pricing changes do not retroactively alter fees already paid or an active fixed-price agreement unless that agreement expressly permits the change or the client separately approves it in writing.

Eleable® is committed to maintaining rigorous accessibility practices and to supporting managed websites using current ADA- and WCAG-informed standards. Accessibility is an ongoing process, and no website can be guaranteed to remain permanently free from every accessibility issue because content, software, browser behavior, third-party tools, technical standards, and legal requirements may change over time.

When Eleable® manages or maintains a website, new issues may arise that fall outside the services included in the client’s existing plan. These may include substantial accessibility remediation, security repairs, software conflicts, third-party integration failures, hosting or domain issues, major content changes, platform updates, emergency support, or work caused by changes made by the client or another provider.

Eleable® may recommend or offer additional services and fees when such work is reasonably necessary. Unless an existing written agreement expressly includes the work or authorizes the charge, the client is not obligated to purchase the additional service. Eleable® will disclose the nature and price of the proposed work and obtain the client’s written approval before beginning or billing for it.

If a client declines optional additional work, Eleable® may be unable to correct the issue, maintain a particular feature, continue supporting an affected third-party service, or represent that the website remains within the scope of Eleable®’s current accessibility or maintenance review. Declining optional work does not create a payment obligation, but it may limit the services, support, monitoring, or assurances Eleable® can reasonably continue to provide.

Non-Clinical Services Disclaimer

While Gabrie’le Eato may have education or experience in psychology-related fields, including psychometrics, all services provided through Eleable® are strictly non-clinical unless explicitly stated in a separate written agreement.

Eleable® does not provide therapy, diagnosis, medical treatment, counseling, or crisis services.

AI & Automation Use

Eleable® may use limited AI-assisted tools to support internal workflows such as drafting, formatting, accessibility checks, or analytics review.

We do not train public or proprietary AI models on client data, do not sell or license client data for AI training, and do not permit third-party tools to retain or reuse personal information beyond providing the requested service.

Analytics, Cookies & Advertising

We may use analytics and performance tools to understand usage patterns, improve services, and measure effectiveness.

Eleable® does not sell personal data, does not engage in cross-context behavioral advertising, and does not build third-party advertising profiles.

Cookies may be used for functionality, analytics, and performance. You may manage cookies through your browser settings.

Third-Party Service Providers

We work with trusted third-party providers such as hosting services, payment processors, scheduling tools, and analytics platforms. These providers process limited data only to perform services on our behalf.

Data Security

We use reasonable administrative, technical, and organizational safeguards to protect personal information.

However, no method of transmission or storage is 100% secure. We cannot guarantee absolute security of data.

International Data Transfers

If personal information is transferred outside your jurisdiction, we rely on legally recognized safeguards such as Standard Contractual Clauses or equivalent mechanisms as required by applicable law.

Accessibility & ADA/WCAG

Eleable® strives in good faith to support alignment with ADA and WCAG accessibility guidelines through inclusive, neurodivergent-informed design. Accessibility is an ongoing process and cannot be legally guaranteed.

Client Responsibilities & Authorized Content

Clients are responsible for providing complete, accurate, lawful, and timely information, content, credentials, approvals, instructions, and materials needed for Eleable® to perform the requested services. The client represents that they own, license, or otherwise have permission to use all text, images, logos, trademarks, videos, files, data, and other materials supplied to Eleable®.

Eleable® is not responsible for delays, errors, claims, losses, or accessibility issues caused by inaccurate instructions, missing information, delayed approvals, unauthorized materials, client-supplied content, or changes made by the client or another person after Eleable® completes or reviews its work.

Third-Party Platforms, Tools & Service Interruptions

Websites and digital services may depend on third-party hosts, domain registrars, plugins, applications, payment processors, content management systems, analytics providers, social platforms, APIs, browsers, devices, and other outside services that Eleable® does not own or control.

To the fullest extent permitted by law, Eleable® is not responsible for outages, data loss, security incidents, policy changes, price increases, compatibility problems, discontinued features, account suspensions, accessibility defects, or other failures caused by a third-party provider. Work required because of a third-party change or failure may be treated as additional work and quoted separately.

Backups, Security & Ongoing Website Care

Unless a written agreement expressly states otherwise, the client remains responsible for maintaining current backups of website content, account credentials, business records, and other important materials. Eleable® may assist with backups, security, monitoring, or recovery when included in a service plan, but no backup, monitoring system, or security measure can be guaranteed to prevent every loss, breach, interruption, or technical failure.

Limitation of Liability

To the fullest extent permitted by applicable law, Eleable® and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, loss of goodwill, or loss of opportunity arising from or related to the website, services, third-party tools, accessibility issues, maintenance, delays, or these Terms.

To the fullest extent permitted by applicable law, the total aggregate liability arising from or related to a particular service or project will not exceed the amount actually paid to Eleable® for that specific service or project during the six (6) months immediately preceding the event giving rise to the claim. This limitation does not apply where applicable law prohibits or restricts such a limitation.

Events Beyond Reasonable Control

Eleable® will not be responsible for delay, interruption, or failure to perform caused by circumstances beyond its reasonable control, including internet or hosting failures, cyberattacks, utility outages, natural disasters, severe weather, public emergencies, illness, labor disruptions, government action, platform outages, or failures of suppliers and third-party service providers. Deadlines may be reasonably extended while such circumstances continue.

Updates, Severability & No Waiver

Eleable® may update these Terms prospectively as services, technology, pricing, accessibility guidance, or legal requirements evolve. The version posted with the most recent effective or updated date applies to future website use, bookings, renewals, and transactions, except where a separate signed agreement controls.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. A failure or delay in enforcing any provision does not waive the right to enforce that provision or any other provision later.

Dispute Resolution

If you have a concern regarding privacy, data use, billing, accessibility, or legal terms, we encourage you to contact us first so we may attempt to resolve the matter in good faith.

Governing Law

These Terms are governed by U.S. law and the laws of the State of Ohio. Venue is Franklin County, Ohio.

Gabrie’le Eato LLC is the entity under which Gabrie’le Eato operates as a creator, influencer, public speaker, consultant, educator, podcast host, and neurodiversity advocate.

This entity governs public-facing work, professional collaborations, educational services, advisory work, media activities, and advocacy services connected directly to Gabrie’le Eato’s professional expertise.

Eleable Legal Terms

Eleable LLC is a separate business entity dedicated to inclusive digital design, accessibility reviews, branding, marketing, and online visibility services.

Agreements involving Eleable apply specifically to the projects, payments, deliverables, intellectual property, accessibility reviews, and professional relationships managed through that company.

Eleable does not provide clinical, diagnostic, psychological, medical, assessment, or therapeutic services.

NDVerse Legal Terms

NDVerse is a registered nonprofit organization focused on neurodiversity advocacy, inclusion, education, resource navigation, and community support.

Its policies apply to nonprofit programs, community initiatives, educational resources, events, advocacy activities, and organizational participation connected to NDVerse.

NDVerse operates independently from the for-profit entities and does not offer diagnosis, medical treatment, therapy, or commercial professional services.

Entity and Clinical Scope Disclaimer

Gabrie’le Eato holds professional training and experience in psychometrics and may conduct standardized assessments related to autism, ADHD, and learning differences when those services are offered through an appropriate legal entity.

Assessment services are conducted only within applicable professional and legal boundaries. When a clinical diagnosis, medical determination, or formal verification is required, findings must be reviewed and finalized by a licensed physician or another appropriately credentialed professional who is legally authorized to provide that determination.

Psychometric testing is not provided by Eleable LLC and is not offered through NDVerse.

No professional services are offered by Gabrie’le Eato as a private individual. Services, assessments, advocacy activities, collaborations, and professional work are provided through their respective entities.

Provider’s Right to Cancel and Terminate

To the fullest extent permitted by applicable law, Gabrie’le Eato LLC, Eleable LLC, and NDVerse each reserve the sole and unrestricted right to cancel, terminate, discontinue, suspend, or decline to continue any contract, service, project, program, coaching relationship, consulting relationship, collaboration, engagement, or other professional arrangement at any time, with or without cause, and for any lawful reason.

Upon written notice from the applicable entity, the agreement and the entity’s obligation to perform any further services will terminate as of the effective date stated in the notice. No client, participant, collaborator, or other party has a guaranteed right to continued services, continued access, renewal, completion of future work, or continuation of the professional relationship.

All payments are final and nonrefundable. No refund, credit, chargeback, reimbursement, or return of any deposit, retainer, installment, service fee, coaching fee, consulting fee, project payment, or other amount paid will be issued merely because the applicable entity cancels or terminates the agreement, except where a refund is expressly required by applicable law or expressly promised in a separate written agreement signed by the applicable entity.

Cancellation or termination does not erase, rescind, or release obligations that arose before termination. All outstanding balances remain immediately due, and all provisions concerning payment, nonrefundable fees, completed work, intellectual property, confidentiality, limitations of liability, indemnification, dispute resolution, and any other terms intended to survive termination will remain in effect.

This provision controls unless a separate written agreement signed by the applicable entity expressly states otherwise. Nothing in this section permits termination for an unlawful or discriminatory reason, eliminates a nonwaivable statutory right, or overrides any refund, cancellation, or notice requirement imposed by applicable law.
